Lenden Guarantee

Effective Date: 1st December 2025

1. Introduction & Purpose

Lenden aims to build β€” for Bangladesh β€” a trustworthy, secure, and transparent crowdfunding platform. Under this "Lenden Guarantee Policy" ("Policy"), we commit to protect:

  • Donors/Backers, by ensuring their contributions are used for the stated purpose in each campaign, or reach the intended beneficiary/campaign organiser.
  • Beneficiaries or Intended Recipients, by ensuring they receive the funds raised for them (less any fees or platform deductions as previously disclosed).

This Policy applies to all campaigns launched on Lenden after the effective date of this document.

2. Guarantee for Donors / Backers

Donations to Individuals or Campaigns

If a donor supports a campaign for an individual (or non-charity cause) and believes the funds have been misused or not delivered as promised, the donor may file a claim under this Policy. If, after investigation, Lenden determines that misuse or failure to deliver occurred (at its sole discretion), Lenden may refund the donation amount to the donor.

Donations to Registered Charities / Organizations (if supported)

If a donor contributes to a campaign tied to a certified charity or organization on Lenden, the Platform guarantees the donation will reach the intended charity. If the charity becomes unable or unwilling to accept funds (e.g., loss of status, banking obstacles), Lenden may attempt to redirect the donation to an alternate charity with a similar mission β€” or refund the donation β€” consistent with applicable laws and platform policy.

3. Guarantee for Beneficiaries / Campaign Recipients

If you are the named beneficiary (individual or organization) of a campaign, and you are entitled to receive the funds raised, Lenden will ensure disbursement of funds directed to you (subject to platform fees, transaction costs, and compliance with verification requirements).

In the case of a beneficiary charity/organization that becomes unable/unwilling to accept funds (e.g. status change, banking issues), Lenden may redirect the funds to an alternate charity with similar purpose β€” or, if necessary, return donations to donors β€” in accordance with legal/regulatory requirements and platform policy.

4. Limitations / Exclusions

As in GoFundMe's policy, certain situations should be excluded from guarantee coverage for Lenden:

  • Claims submitted more than a fixed period after the campaign ends or after funds were disbursed (e.g., 1 year).
  • Donations made outside the Lenden platform (offline transfers, external payment methods, etc.).
  • Cases where funds were properly delivered to a third-party beneficiary (e.g. by court order, garnishment, or with your written consent).
  • Campaigns in which the donor contributed to the misuse or misdirection of funds (directly or indirectly).
  • Campaigns created by a user for themselves (i.e. self-funding campaigns).
  • Refund requests where a donor already initiated a chargeback externally.
  • Situations where Lenden is unable to send funds to a beneficiary due to regulatory or banking restrictions in Bangladesh.
  • Claims adjudged frivolous, duplicative, or excessive (e.g. more than a certain number per month), at Lenden's discretion.
  • Cases where the campaign organizer or beneficiary violated Lenden's Terms of Service or other relevant platform policies (e.g. identity fraud, prohibited content, illicit activities).

5. Submitting a Claim / Eligibility

To submit a claim under this Policy (as donor or beneficiary), the claimant must:

  • Not have contributed to the alleged misuse or misdirection of funds.
  • For a donor: retain control of the original payment instrument used to donate (or valid refund pathway).
  • For a beneficiary: demonstrate that you did not receive the full amount raised (after accounting for refunds, fees, offline donations, and transaction costs).
  • For a beneficiary: have attempted to resolve the issue with the campaign organizer (e.g. by requesting evidence of proper fund use or distribution).
  • Cooperate fully with Lenden's investigation β€” including providing relevant documentation, responding to inquiries, and if needed, filing a police or legal report in Bangladesh (if misuse or fraud is suspected).

Upon submitting a claim, you agree to cooperate with any internal review by Lenden or, if necessary, law-enforcement investigations. If you later receive compensation from any other source for the same claim (e.g. court order, third-party settlement), you must notify Lenden and return the amount up to the refund provided under this Policy.

6. Investigation & Determination

Lenden will investigate all claims and β€” in its sole discretion β€” determine whether the claim is valid under this Policy and what remedy is appropriate (refund to donor, payment to beneficiary, or other resolution). All determinations are final.

Lenden may β€” at its discretion β€” place temporary holds on withdrawals or disbursements while investigating suspected fraud or misuse.

7. Nature of the Guarantee β€” Disclaimer

This Policy is not an insurance contract. No premium has been paid by donors or beneficiaries. The guarantee is limited to the remedies described (refund or proper disbursement). This Policy does not guarantee success of a fundraising campaign, achievement of funding goals, or the ultimate outcome of the funded project or cause.

8. Modifications & Termination

Lenden reserves the right to modify or terminate this Guarantee Policy at any time β€” in its sole and absolute discretion β€” without prior notice. Changes will be published on the Lenden website or communicated to users. Any campaigns/donations made after the effective date of modification will be subject to the new policy; claims regarding earlier donations will be governed by the version applicable at that time.

9. Relationship with Terms of Service

This Policy supplements, but does not replace or supersede, Lenden's standard Terms of Service (or other relevant platform agreements). In case of any conflict, the Terms of Service will prevail.
